our court case is coming to an end and the judge told us he will give us a judgement award . I questioned the judge and asked him WHO was going to pay this award?? I asked would he pay it he said no the court was not responsible, so I ASKED WOULD THE GOVERNMENT PAY HE SAID NO! I ask so why do you punish us we are the victims why do we have to pay ! The builder was sitting in court I said why dont you punish him He said this is not a criminal court! so who has the answer !! ALL the cases end the same and the Lawyers know this they just get richer by cashing in. Who has the solution?

Who has the solution? The rest of the world,by allowing the embargoes and isolations to happen turkish CYPRİOTS and allowing turkey's accupancy to go on as long as it has. But,in my opinion it is now too little too late, there aren't many turkish CYPRIOTS left on the island since we only hold about quarter of the population..........and thats the legal ones....... ps.got a funny feeling I've writton this before also................on this very forum.

Yes, but it took 5 years and the case was against a private seller ( not constructor). In the end the sellers house was to be auctioned by order of the court so he paid up.

Yes,my neighbour successfully sued our UK developer and within 4 months received payment. I'm now going through the same legal process with the same developer. All is not lost so don't give up.

Court Judgements: The courts can give a judgement in your favour and if the builder does not pay you can take out a writ against his "movables" i.e. money in the bank, car, household goods etc. After that if not fully satisfied you can ask for forcefull sale of his "immovables". If he is a man of straw, the court will order him to pay by monthly installments in accordance with his earnings. Note the installments will be in accordance with his earnings and not his debt. A man is not sent to prison for not being able to pay his debt but will be sent to prison for disobeying a court order wrt monthly installments. ismet

Pauline Read has waited nearly 2 years, so far, for the Tapu to sanction the auctioning of "immovables" the court requested the sale of. I would be interested in knowing how many of those who did get paid were citizens who would therefore not go away. What I'm saying is that ex-pats often give up and go back to their original countries and so delaying tactics have more chance of working. Sorry for being cynical.

Well I know Pauline is not going away until she gets what she is owed ! And I dont blame her ...... Why should they be able to get away with it ! This is good hard earned cash and it doesnt come easy so why give up. We are all victims ex pat or not. I know many London T.C's that came to their "HOMELAND?" because of their love of the island, and end up going back to England with nothing. But I will not go quitely .... about time something was done about it !
