| We all know that moraly that the developer should be responsible for the annual property council tax as quite simply the property still belongs to the developer if no deeds have been handed over. However I would like to see something official from the recognised authorities to confirm this !! Can any one help ? |

| Pipie, we are all aware that in a ideal world the developers would pay the Property tax until such time the Kocan is transferred but they dont so i would advise anyone who has taken possession of a property to pay their property tax otherwise when it comes to the time for transfer of title to take place you could end up with a large bill because the land registry will not transfer with out this tax being up to date. Art, the transfer tax becomes payable at such time the kocan is to be transferred from the developer to yourself. |

| tranfer and pay taxes , you cant transfer if i recall until all taxes are paid .The transfer takes place t the tapu,but you may not physically get your kocan in your name for a year or more after. They do give you a registration number to check with though i may be not 100% as memory gets confused kav |

| Kav is correct Art in that although you pay your transfer tax at the time of transfer you will not actually receive your kocan until some time after. |

| My Kocan came through about 3 months after transfers were done. Perhaps they are not very busy now doing transfers so might be quicker than that notwithstanding strike action of course |

| Pipie i agree if you know 100% that title will never be transferred then why pay although my advise above is based on owners that hope to receive their kocan and dont wish to have the added cost of a number of years property tax to be added to their costs when transfer occurs. The choice is yours !! |

| Cooper I have mine also fully paid up on my council tax. However I know a few owners who have no sight of their deeds so in my view why on earth should they pay council tax on a dwelling they will never have deeds for !! The problem I see is no actual official advice on this ?? Any one out there know ? |

| Pehaps Piepie people should consider having paying the council tax as they live in the house, a bit like paying CT on a rented property. Remember. technically, if anyone is living in what in law is still their builders house, he might decide to start charging rent. |

| yrret. I understand what you are saying and yes if some owners live in there poperty all year round perhaps they would feel an obligation to pay annual council property tax !! On the other hand if any law says the buider/developer is responsible and couple this up with the builder/developer refusing deeds then why should they not be responsible for the council debt !! example a builder/developer builds/sells an apartment complex of say 500 dwellings refuses to hand over deeds to these innocent owners as a backlash in my view that buider should then take the responsibility of paying all of that council tax = 500 x annual council charge of each dwelling. My opinion only !! |

| From what I understand at the moment all advocates who are members of the TRNC Bar Association are not allowed to to do any transfers for their clients at the Tapu office as there is a bar on them doing this. This is due to the fact that the TRNC Bar Association is disputing the increase in taxation that was retrospective, from what I am told. If someone has their PTP you can do this transfer yourselves but there will be no legal back up from the TRNC Bar Advocates. |
